Public opinion and outrage over drunk driving has led to increasingly tougher DWI laws. These are the current penalties a repeat offender can expect to receive in the state of New York:

  • For a second offense within a ten-year period: For a misdemeanor, fines up to $1,000, up to a year in jail and driver's license suspension of up to a year; for a felony DWI, fines up to $4,000, up to four years in jail and revocation of your license for up to a year.
  • For a second repeat offense within a ten-year period: This is a Class D felony with fines of up to $10,000, jail time of up to seven years, plus five years of probation, and license revocation of 18 months.
  • For a second offense within a five-year period: Fines up to $4,000, a mandatory five days in jail or 30-day community service obligation plus mandatory installation of an ignition interlock system. These are additional penalties: You may also be facing the penalties prescribed for a second-offense felony DWI.
