Penalties and fines associated with a DWI are tied to several things; among those is your blood alcohol level, or BAC. If you have tested with a blood alcohol level of .08, and this is your first offense, you will be charged with a misdemeanor DWI. A blood alcohol level of .17, or twice the legal limit, is an enhanced misdemeanor with no opportunity for a plea bargain. You could also receive a DWAI (driving while ability impaired) for a BAC of .05, which carries lesser penalties.
